These Terms of Service ("Terms") govern your access to and use of the rku command-line tool, the rku dashboard at hub.rku.dev, and related services (together, the "Service"), provided by Nami ML Inc. ("Nami ML," "we," "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

rku automates the Roku Developer Portal on your behalf so you can publish and manage Roku channels from your terminal or your CI/CD pipeline. The Service acts as your agent against Roku's systems using credentials you provide.

Your Roku account and Roku's terms

The Service interacts with the Roku Developer Portal using your Roku Developer account. You are responsible for maintaining a valid Roku Developer account and for complying with Roku's own developer agreements, policies, and terms. rku is an independent tool and is not endorsed by, sponsored by, or affiliated with Roku, Inc. Your use of Roku's platform remains subject to Roku's terms, and nothing here overrides them.

Accounts and responsibilities

You must provide accurate information and keep your account credentials secure.
You are responsible for all activity that occurs under your account and for the channels, packages, and content you publish through the Service.
You must have the rights necessary to publish the content you submit.
Notify us promptly at support@rku.dev if you believe your account has been compromised.

Acceptable use

You agree not to:

Use the Service to violate any law or the rights of others, including Roku's terms or intellectual property rights.
Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its underlying systems.
Use the Service to distribute malware or to publish unlawful, infringing, or harmful content.
Interfere with, overload, or abuse the Service or any connected systems, including Roku's.

Plans and billing

Some features of the Service are offered free of charge, and others may require a paid plan. Where paid plans apply, the applicable fees, billing cycle, and terms will be presented to you at the time of purchase. Unless stated otherwise, fees are non-refundable except as required by law.

Intellectual property

The Service, including its software, design, and content, is owned by Nami ML and protected by intellectual property laws. You retain ownership of the content you publish through the Service. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that publishing operations against Roku's systems will always succeed, since those systems are outside our control.

Limitation of liability

To the fullest extent permitted by law, Nami ML will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim, or one hundred U.S. dollars (USD $100) if you paid nothing.

Indemnification

You agree to indemnify and hold harmless Nami ML from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others, to Roku's systems, or to us. Provisions that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in Delaware, unless otherwise required by applicable law.
